1. Personal data:

Personal data is personal information and factual information that can be clearly assigned to a specific natural person (for example, your name, address, telephone number, date of birth, company information, etc.)

1.1. Collecting personal data:

If a user provides us with personal data via this website, this is done on a voluntary basis. This also applies to personal data that has been provided to us by third-party companies via booking platforms, as well as via travel agencies and voucher platforms. Our contracting partners are obligated to handle the data shared with them in compliance with data protection law, and to take all organisational and technical measures required to protect your data.

1.2. Using personal data within the scope of getting in touch or making a request:

In addition to getting in touch or sending requests (for example, booking requests) by email, we also have an online form for this. With this service, personal data is stored for the purposes of processing the request.

Data provided by the user is not shared with third parties, and no comparisons take place, unless we are obligated to share data with authorities or state institutions based on mandatory legal regulations (registration data).

1.3. Using and sharing personal data as part of a business relationship:

Personal data shared as part of a business relationship is collected, stored and processed by us as part of the business relationship. The data is only used for the purposes of providing services and administration.

Personal data is not shared with third parties, and no comparisons take place, unless we are obligated to share data with authorities or state institutions based on mandatory legal regulations (registration data).

1.4. Using personal or business data as part of a comment or review:

The user may leave comments or reviews on this website by using an online form.

With this service, we store personal data as well as the IP address of the user’s machine and the date and time. This storage provides security for us should the author breach third-party rights or send and save unlawful texts (for example, hate posts).

Personal data is not shared with third parties, and no comparisons take place, with the exception of requests from prosecuting authorities if the author breaches the law or regulations, within the context of legally applicable provisions.

1.5. Using personal data in the form of image media:

If users voluntarily send us personal data in the form of digital image media, we are entitled to save these images and videos and publish them on our website. When sending image materials, users are also providing us with consent.

Image media sent by the user is not shared with third parties, and no comparisons take place.

2. Cookies:

We use cookies on most pages to provide the user or customer with the best possible service and level of user-friendliness.

Cookies are small text files that the browser places and saves on the user’s computer in order to communicate user information, user behaviour and the IP address used, for example. Most browsers automatically accept cookies. The browser can also be configured in such a way that prevents cookies from being saved or in such a way that a notification alerts you when text files are being saved.

We usually use ‘session cookies’ (session ID), which are deleted again immediately after you close the browser. Cookies from third-party providers are also used.

3. Third-party providers:

3.1 Embedding or linking to Facebook:

External links to the social network ‘Facebook’ are integrated into this website. Facebook is operated by the company Facebook Inc., headquartered in 471 Emerson St. Palo Alto, CA 94301-160, (USA).

As the privacy of our users is very important to us, we don’t use any plug-ins, and instead use image or text links. As such, no direct connection is established between the user’s browser and Facebook servers when visiting this website. Social networks only receive information if users click onto links or are signed into the respective user account.

We do not know what content is collected and sent, nor do we know how such data is used by the operator of Facebook. Signing out of the respective user account prevents Facebook from being able to associate the respective user’s user account with our website.

Data protection by Facebook

3.2. Embedding YouTube videos:

Videos may be embedded on this website that are hosted by the company and the external provider ‘YouTube’.

YouTube LLC is located in 901 Cherry Ave., San Bruno, CA 94066 (USA) and is a subsidiary of Google Inc., headquartered in 1600 Amphitheatre Parkway, Mountain View, CA 94043, (USA).

We use YouTube’s ‘ - Privacy-enhanced mode - ’ option. If you access a page on our website that contains an embedded video, a connection will be established with YouTube servers and the content will be displayed on the website via a message being sent to your browser. According to information provided by YouTube, in ‘ - Privacy-enhanced mode - ’, data is only sent to YouTube servers if you watch the video, with particular reference to which of our web pages you have visited. If you are signed into YouTube at the same time, this information is associated with your YouTube member account. You can prevent this by signing out of your member account before visiting our website.

Data protection by YouTube on Google

3.3. Google Maps/Google Earth embedding:

Maps from Google Maps/Google Earth from the company Google Inc., headquartered in 1600 Amphitheatre Parkway, Mountain View, CA 94043, (USA), are embedded and linked to on this website.

Each time the Google Maps/Google Earth components are accessed, Google stores a cookie to process user settings and data when displaying the site on which the Google Maps/Google Earth components are integrated. This cookie is generally not deleted when you close the browser, but expires after a set period of time, unless you manually delete it beforehand.

If you, as a user, do not agree to this processing of your data, there is the option of deactivating the Google Maps/Google Earth service and preventing data from being sent to Google by doing so. You must deactivate JavaScript in your browser for this. Please note that if you do so, you will not be able to use Google Maps/Google Earth, or may only be able to use them in a restricted way.

Google (Terms of Service) / Google Maps (Terms of Service)

3.4. Embedding of Google reCaptcha:

The Google service ‘reCaptcha’ is integrated into this website to protect input forms against spam and unauthorised access. Google reCaptcha belongs to the company Google Inc., headquartered in 1600 Amphitheatre Parkway, Mountain View, CA 94043, (USA).

The purpose of this is to ensure that people, and not an automated and abusive programmed sambot, input into forms. When using reCaptcha, the IP address, the user’s input into forms and other user information or user behaviour - required for the reCaptcha service - is sent to Google for further use. Here, the IP address is truncated by Google in states that belong to the European Union or in other signatory states to the Agreement on the European Economic Area before it is sent. A full IP address is only sent to a Google server in the USA and truncated there in exceptional cases.

This data is sent to Google by order of the operator of the website for the purposes of evaluating the reCaptcha service. Google only merges the IP address sent with other ‘Google data’ if the user is signed into his/her Google account when using the reCaptcha service. This can be prevented by signing out before clicking on or inputting user data in reCaptcha.

Google data protection

3.5. Embedding Google Analytics

This website uses Google Analytics, a web analysis service from Google Inc, 1600 Amphitheatre Parkway Mountain View, CA 94043, USA (‘Google’) on the legal basis of overriding legitimate interests (analysis of website use).

We have concluded a contract relating to contract data processing with Google for this. When accessing our website, a connection is established with Google servers using software, and data is sent to Google servers partly in the USA. Google Analytics also uses cookies to save information about the website user and to analyse the website user’s use of the website. This website uses the ‘IP anonymisation activation’ function. This means that your IP address is truncated by Google within the member states of the European Union or in other signatory states to the Agreement on the European Economic Area before it is sent. A full IP address is only sent to a Google server in the USA and truncated there in exceptional cases. According to Google, data collected by Google is used to evaluate the use of the website, to compile reports about website activities and to provide other services to us that relate to website and internet use. Google will also send this information to third parties if this is legally permissible or if third parties process this data by order of Google.

Here, cookies are used that allow visitors’ use of the website to be analysed. Information generated through this is sent to the provider’s server and saved there. You can prevent this by changing your browser’s settings so that it doesn’t save any cookies. We have concluded a corresponding contract for contract data processing with the provider. User data is stored for a period of ... [enter storage period] [this must be clarified with the web analysis service].

MailChamp data protection: (Privacy and Terms).

5.1. Withdrawal and information about personal data:

5.2. Rectification and erasure of personal data:

The careful and secure handling of personal data is a matter of course for us. We protect your data against unauthorised access and loss. As such, data is stored in an environment secured by technical measures, or on external data media. Only a few authorised persons handle your data.

7. Server data (server log files):

For technical reasons, our web hosting provider collects data about the access to this website and saves these as server log files. We have no control over the collection of this data.

  • The following server data is collected and recorded:
  • IP address/host name of the requesting machine;
  • date and time of access;
  • user’s browser type and browser version used;
  • user’s operating system used;
  • referrer URL (source and note about the user’s origin - normally a URL); and
  • volume of transferred data in bytes.

The collected data is only used for statistical evaluations and to improve the website. The data does not allow any conclusions to be made about you personally. However, we reserve the right to subsequently review server log files should specific indications suggest unlawful use.

8. Video surveillance:

For information, it is also noted that our hotel lobby has video surveillance for security reasons. The moving images recorded are stored for a maximum of 72 hours and then deleted. No risk assessment is carried out to protect the stored data in this regard. Due to the risk potential or protection of property belonging to Hotel Momentum and its guests, such video surveillance is regarded as proportionate in all instances.

Furthermore, surveillance is carried out in the entrance and climbing area in the ‘Südwand/South Wall’ climbing wall, where this surveillance is solely for actuarial issues and any liability issues. The moving images recorded are stored for a maximum of 72 hours and then deleted. This is particularly required and proportionate in order to protect our guests and their physical well-being in case an accident happens.
